1. Introduction

Welcome to BhubSolar. These Terms and Conditions govern your access to and use of our solar energy financing, rent-to-own equipment, and related services in Nigeria. By submitting an application, paying a deposit, or using any BhubSolar equipment, you agree to be bound by these Terms and Conditions. Please read them carefully.

2. Service Description

BhubSolar ("the Company", "we", "us") provides Pay-As-You-Go (PAYG) solar and inverter systems to homeowners and Small and Medium Enterprises (SMEs). Our services include the provision, installation, and financing of solar equipment ("the Equipment") over a specified repayment period (the "Tenor").

3. Eligibility and Verification

To be eligible for BhubSolar financing, you must be a resident of Nigeria, be at least 18 years old, and possess a valid National Identity Number (NIN). You consent to the Company verifying your identity and creditworthiness using your provided NIN through authorized credit bureaus and identity verification agencies in Nigeria.

4. Payment Obligations

  • Payment Schedule: You agree to make regular payments (Daily, Weekly, or Monthly) as defined in your specific Quote and Customer Agreement.
  • Monnify Accounts: All payments must be made to the dedicated virtual bank account provided to you by our payment partner, Monnify. Payments made to unauthorized accounts will not be recognized.
  • Zero Down Payment: Certain plans qualify for zero down payment subject to credit approval. Installation will commence only upon approval and signing of the final agreement.

5. Retention of Title (Ownership)

Crucial Condition: The Equipment remains the absolute property of BhubSolar until all scheduled payments (including any late fees) have been paid in full. You are acquiring the Equipment on a "rent-to-own" basis. Upon successful completion of all payments, full ownership of the Equipment will automatically transfer to you.

6. Maintenance, Warranty, and Use

  • Warranty: The Equipment comes with a standard 2-year warranty covering manufacturer defects.
  • Prohibited Actions: You must not tamper with, relocate, sell, pawn, or attempt to modify the Equipment. The PAYG locking mechanism integrated into the inverter must not be bypassed.
  • Damage: You are responsible for any physical damage to the Equipment caused by negligence, theft, or natural disasters while it is in your possession.

7. Default and Repossession

In the event of failure to make scheduled payments:

  • Remote Lock: BhubSolar reserves the right to remotely lock the inverter system, temporarily suspending your access to power until arrears are cleared.
  • Repossession: If an account remains in default for a period exceeding thirty (30) consecutive days, BhubSolar reserves the right to physically recover the Equipment from your premises without prior court order, in accordance with the signed undertaking.
  • Forfeiture: Upon repossession due to default, all previous payments made shall be forfeited and treated as rental fees for the period the Equipment was utilized.

8. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from or in connection with these terms shall first be attempted to be resolved amicably through mutual negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the Nigerian courts.
